Introduction

Riding the Rainbow initiative was created in response to the influx of refugees from Ukraine. Riding the Rainbow started with the donation of a single bike from a garage but now facilitates the donations of other items to young refugees. The app was created by Ukrainian developers and is the first of its kind in Europe, it has plans to expand across national borders and serve refugees from diverse backgrounds. Through the app donations are made easier, refugees and donors register in a few simple steps, and the registration process also enhances the safety of all users. The app is location-based, meaning it addresses logistical and additional environmental concerns.
The Riding the Rainbow app is an invaluable platform that allows long-term residents and refugees to engage directly, using technology to realize further objectives beyond a one-off donation. The innovative app is designed to be a platform for the broader integration and inclusion of refugees. It is also hoped that this innovative app will further transcend borders and become an international platform for individuals and organizations looking to make a difference in the lives of young refugees. The app lends itself easily to a variety of causes and can be easily adapted for diverse sociopolitical and cultural contexts.

1. Who manages and can use Riding the Rainbow

1.1. These Terms and conditions govern your use of this website and mobile app (further on in the text – «Application»). By using the Application, you accept these Terms and conditions in full and without reservation.
1.2. You must be at least 18 [eighteen] years of age to use this Application. By using this Application, you agree to these Terms and conditions, warrant and represent that you are at least 18 years of age.
1.3. Riding the Rainbow is managed by Afrilanthropy a.s.b.l., which is registered at 10 Rue des Muguets, 2167 – Luxembourg and is a charitable, non-governmental organization (Registered with Luxembourg Chambre of Commerce, registration number F11610).
1.4. By using the site and mobile app, you confirm that you accept these Terms and conditions and that you agree to comply with them. If you disagree with these Terms and conditions or any part of these Terms and conditions, you must not use this Application.

2. Description of Riding the Rainbow services

2.1. The facilities and services provided by Riding the Rainbow are as follows:
2.1.1. Riding the Rainbow as Facilitator: You understand that Riding the Rainbow is only a facilitator for the donations to reach the cause to which you have donated. At the same time, you can help the needy yourself using our Application. To do this, you can arrange a meeting with the person in need and hand over things to them.
2.1.2. Financial transactions with donations: Users can use Riding the Rainbow’s tools to donate to a cause they care about and help those in need. If you donate through a payment gateway, you understand that the payment gateway is provided by a third party and is governed by such a third party’s terms and conditions. You are responsible for violating any terms of such third party when you donate. Riding the Rainbow is not responsible for any such errors or failure to fulfill your donation.
2.1.3. Donation Use and Feedback Reports: Riding the Rainbow may provide a report on the use of donations you have made within a reasonable time frame. The feedback reporting period may vary depending on the nature of the donation’s use.

3. Community Guidelines

3.1. After reading all the rules, we will be happy to welcome you to our community. Through our platform you can not only take and donate items, establish new connections, share experiences, and give advice. Beyond the donation, your support and advice can be very important for people who had to leave their homes and start a new life in a new country. In order to best fulfill our mission as an initiative, all users must adhere to the principles of general honesty, kindness and respect. We hold all users to the same standards and have zero tolerance for those who do not adhere to our organizational values.
3.2. Our Application is NOT a platform for:
3.2.1. Nudity or sexual content
Our app is a multifaceted platform, but it is not a space for any form of sexual contact between users. Behaviors, conversations and comments that could make people uncomfortable are not accepted on the app or in person. Do not engage, or encourage others to engage, in any targeted abuse or harassment against any other user. This includes sending any unsolicited sexual content.
3.2.2. Unwanted contact
Though our platform promotes direct connections between users, contact should end when the delivery is complete, unless it is with mutual consent. Texting, calling, social media contact, visiting, or trying to visit someone in person after the delivery has been completed is not allowed. If any user decides that they no longer want to go through with or accept the donation the conversation ends there.
3.2.3. Threatening and rude behavior
Again, we are a platform that encourages kindness towards others and the planet, so naturally we do not accept aggressive or confrontational behaviour. Do not use language or gestures that could be disrespectful, threatening, or otherwise inappropriate We also recommend users to avoid discussing personal topics that can be divisive and provocative such as political views or religion.
3.2.4. Discrimination
You should always feel safe and welcome. That’s why we don’t tolerate conduct we’ve determined to be discriminatory. Do not discriminate against someone based on traits such as age, colour, disability, gender identity, marital or civil partnership status, national origin, race, religion, sex, sexual orientation, or any other characteristic protected under relevant law.
3.2.5. Minors
We exist to help children and young people, but for safety reasons, you must be 18 to use the app. Parents and guardians must be present during the pick up or delivery of items.
3.2.6. The offering or soliciting of services and/or compensation
This is a multifaceted platform that aims to accommodate all our users. However, this is NOT an app for the sale of items, job seeking, or service provision of any kind.
3.3. These content standards apply to any material you transmit through our site and mobile app (communications) and any related interactive services.
3.4. In order to preserve the original design of this platform and charitable intentions, communication between participants must not be:
  • contain any material which is defamatory of any person;
  • contain any material which is obscene, offensive, hateful or inflammatory;
  • promote sexually explicit material;
  • promote violence;
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • infringe any copyright, database right or trade mark of any other person;
  • be likely to deceive any person;
  • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • promote any illegal activity;
  • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
  • be likely to harass, upset, embarrass, alarm or annoy any other person;
  • be used to impersonate any person, or to misrepresent your identity (other than as your registered user name) or affiliation with any person;
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

4. Donations

4.1. You can donate to selected causes on Riding the Rainbow using a number of payment methods such as credit or debit cards or cheque.
4.2. All donations made through Riding the Rainbow are NON-REFUNDABLE. Please contact Riding the Rainbow immediately if there are justifying reasons or circumstances for refund and your case may be reviewed on a best effort basis and decision of Riding the Rainbow will be final.
4.3. Riding the Rainbow reserves the right at any time from time to time to modify or discontinue, temporarily or permanently the donation facility with or without notice.

5. Intellectual property rights

5.1. You may view, download for caching purposes only, and print pages, files or other content from the Application for your own personal use, subject to the restrictions set out below and elsewhere in these Terms and conditions.
5.2. Use of the site and mobile app and its content does not transfer or otherwise grant to any user any right or interest in the Riding the Rainbow intellectual property rights or any intellectual property rights owned by a third party.
5.3. Our status (and that of any identified contributors) as the authors of material on our site and mobile app must always be acknowledged. You must not modify the content or digital copies of any materials you have printed off or downloaded in any way.
5.4. Some documents and photos have been published on the site and mobile app with the permission of the relevant third party copyright owners. All rights are reserved on these documents and permission to copy them must be requested from the copyright owners.
5.5. Considering all of the above, you must not:
  • sell, rent or sub-license material from the Application;
  • show any material from the Application in public;
  • reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
  • redistribute material from this Application – except for content specifically and expressly made available for redistribution;
  • republish or reproduce any part of this website through the use of iframes or screenscrapers.
5.6. Where content is specifically made available for redistribution, it may only be redistributed within your organisation.
5.7. Unless otherwise noted, Riding the Rainbow and/or its licensors own the intellectual property rights in all posted materials. All intellectual property rights are reserved.

6. User content

6.1. In these Terms and conditions, «your user content» means material (including without limitation text, images, audio material, video material, and audiovisual material) that you submit to this website or mobile app, for whatever purpose.
6.2. You grant a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant the right to sublicense these rights, and the right to bring an action for infringement of these rights.
6.3. Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or a third party (in each case under any applicable law).
6.4. You must not submit any user content to the Application that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaints.
6.5. Riding the Rainbow rights under these Terms and conditions in relation to user content does not undertake to monitor the submission of such content to, or the publication of such content on, this Application.
6.6. User Submissions do not reflect the views or opinions of Riding the Rainbow, its agents and/or affiliates. Messages reflect the views and opinions of the person sending them. To the fullest extent permitted by applicable law, Riding the Rainbow shall not be liable for any posting or any liability, loss, or expense caused and/or incurred as a result of any use and/or publication, and/or appearance of any posting on this Application.
6.7. Riding the Rainbow reserves the right to monitor all messages and remove any that may be deemed inappropriate, offensive or in violation of these Terms and Conditions.
6.8. You warrant and represent that:
  • you have the right to send messages on our Application and have all the necessary qualifications and consents to do so;
  • messages do not infringe any rights of any third party;
  • messages do not contain any defamatory, abusive, obscene or otherwise illegal content that constitutes an invasion of privacy
  • comments will not be used to solicit or promote businesses or practices, or to represent commercial or illegal activities.
6.9. If you upload any content to our site and mobile application or use the site and mobile application to make contact with other users, you must comply with these Terms and conditions and, in particular, the content standards below. You warrant that any such contribution complies with these Terms and conditions, and you indemnify us for any breach of that warranty (meaning that you must reimburse us for any costs we incur as a result of your breaching those standards).
6.10. Any communication or material that you transmit to, or post on, any public area of the site and mobile application including any data, questions, comments, suggestions, or the like, is, and will be treated as, non-confidential and non-proprietary information.
6.11. You agree not to create a false identity on the Application, impersonate any person or entity (including members of Riding the Rainbow) or falsely state or otherwise misrepresent yourself, your name, your age or your affiliation with any person or entity.
6.12. Riding the Rainbow reserves the right to investigate and take appropriate legal action against anyone who, in Riding the Rainbow opinion, violates this provision, including, without limitation, reporting you to appropriate law enforcement authorities.

7. Terms of use

7.1. You must not use this Application in any way that causes, or may cause, damage to the Application or impairment of the availability or accessibility of or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
7.2. You must not use this Application to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
7.3. You must not conduct any systematic or automated data collection activities on or in relation to this Application without’s express written consent. This includes: scraping; data mining; data extraction; data harvesting.
7.4. You must not use this Application or any part of it to transmit or send unsolicited commercial communications.
7.5. You must not use this Application for any purposes related to marketing without the express written consent of Riding the Rainbow.
7.6. Riding the Rainbow may change these Terms and Conditions at any time by amending this page. Please check this page from time to time and take notice of any changes. Your continued use of the site and mobile application constitutes your acceptance of these Terms and conditions as modified.
7.7. Riding the Rainbow may reserve the right to restrict access to certain sections of this Application or, at our discretion, to the entire Application.
7.8. When you sign up to become a user of Riding the Rainbow, you will be asked to choose a password. You hereby agree not to use the account or password of another user at any time or to disclose your password to any third party. You agree to notify Riding the Rainbow immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
7.9. If you provide a user ID and password to access restricted areas of this Application or other content or services, you must ensure that the user ID and password remain confidential. You are solely responsible for the security of your password and user ID.
7.10. Without prejudice to other rights under these Terms and conditions, if you breach these Terms and conditions in any way, may take such action as deems appropriate to deal with the breach, including suspending your access to the Application, prohibiting you from accessing the Application, blocking computers using your IP address from accessing the Application, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
7.11. You are responsible for making all arrangements necessary for you to have access to our site and mobile application. You are also responsible for ensuring that all persons who access our site and mobile application through your internet connection are aware of these Terms and conditions, and that they comply with them.
7.12. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site and mobile application or to your downloading of any content on it, or on any website linked to it.

8. No guarantees

8.1. This Application is provided «as is» without any representations or warranties, express or implied. Riding the Rainbow makes no representations or warranties about this Application or the information and materials provided on them.
8.2. Without prejudice to the general nature of the preceding paragraph, does not guarantee that: this Application will be available at all times or at all; the information on this Application is complete, true, accurate, and not misleading.
8.3. We cannot guarantee that this Application will be available on all types of devices (including older ones). We make no promises that the application will always be uninterrupted and/or error-free. To the extent allowed by law, we are not responsible or liable for any interruptions of the app’s availability or any delays, inaccuracies, errors, or things missing on the app.
8.4. Nothing on this Application is or is intended to constitute advice of any kind. If you need advice on any legal, financial, or medical matter, you should consult an appropriate professional.
8.5. Riding the Rainbow will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this Application:
  • to the extent that the Application is provided free-of-charge, for any direct loss;
  • for any indirect, special or consequential loss;
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
8.6. These limitations of liability apply even if you have been expressly advised of the potential damages. While the website or mobile application and the information and services on the website or mobile application are provided free of charge. We are not responsible for any loss or damage of any kind.

9. Third party links and resources

9.1. Riding the Rainbow takes no responsibility for the content of external Internet sites. Other websites that we link to are owned and operated by third parties, and Riding the Rainbow has no control over them.
9.2. The fact that we include links to other websites does not mean that Riding the Rainbow approves of or endorses any other third party website or the content of that website. We accept no liability for any statements, information, products, or services that are published on or are accessible through any websites owned or operated by third parties.

10. Availability

10.1. Riding the Rainbow aspires to be a dynamic Application by adding new features and content regularly for the benefit of visitors. For this purpose Riding the Rainbow Application may be temporarily shut down for updation work. However, Riding the Rainbow will put its best efforts to minimize the inconvenience caused due to non-availability of Application.
10.2. At Riding the Rainbow we make every effort is made to keep the Application up and running smoothly. However, Riding the Rainbow takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to issues beyond our control.

11. Unenforceable provisions

11.1. If a provision of these Terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
11.2. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

12. Indemnity

12.1. We are in no way responsible for the organization and holding of the meeting between the recipient and the donor, the general condition of the transferred items, and their further use.
12.2. You hereby indemnify and undertake to keep indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by to a third party in settlement of a claim or dispute on the advice of legal advisers) incurred or suffered by arising out of any breach by you of any provision of these Terms and conditions, or arising out of any claim that you have breached any provision of these Terms and conditions.

13. Assignment

13.1. Riding the Rainbow may transfer, sub-contract or otherwise deal with rights and/or obligations under these Terms and conditions without notifying you or obtaining your consent.
13.2. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these Terms and conditions.

14. Linking to our site and mobile application

14.1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

15. Appearance

15.1. Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.

16. Reservation of Rights

16.1. We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request.
16.2. If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.
16.3. Riding the Rainbow and partner organizations are not responsible for the quality, suitability and usability of items donated by donors through the app.

17. Your Privacy

17.1. The privacy notice is an integral part of the Terms and Conditions, this website and the mobile application. By using this Application, you confirm that you have read and agree to all Terms and conditions of the privacy notice.
